ABSTRACT
Red light theories are based upon the model of law within the balanced constitution. Proponents would see it to be the function of the courts to control the executive. This is often undertaken from the standpoint of a belief in individualism and the view of the constitution as ‘an instrument for protecting the fundamental rights of the citizen and not an instrument for enabling the community to provide services for the benefit of its citizens’.
