Held Following Cobra Golf Inc v Rata [1998] Ch 109, proceedings for civil

contempt are proceedings for ‘recovery of a penalty’ for the purpose of

s 14 of the Civil Evidence Act 1968 and, accordingly, the privilege of

self-incrimination applies to them.
