ABSTRACT

The proposed Council Directive for the harmonisation of legislative, regulatory and administrative provisions of Member States on advertising, hereinafter referred to as the Ad-ban Directive, was preceded by a proposed Council Directive presented by the Commission in 1989. The main objectives of that first proposal presented by the Commission were: (a) a prohibition on advertising tobacco products in publications aimed at

minors under 18 years (Art 1); (b) the establishment of rules and regulations regarding the form and content

of advertising in the general press and on placards (Arts 2 and 3); (c) to guarantee free circulation in the internal market of products that

comply with the requirements of the Directive (Art 5(1)).
