Admissibility

This is the most basic of all evidential concepts. Evidence will only be accepted by the court where it is admissible. Admissible evidence is evidence which, as a matter of law, is capable of being put before the court. Questions about the admissibility of evidence are questions of law to be decided by the judge in the Crown Court and by the bench in the magistrates’ court after taking advice from the magistrates’ clerk and by the judge in the High Court and county court.
