ABSTRACT

This chapter covers a vast area which forms the final part of the social welfare section of law with which social workers are likely to confront in practice. Unfortunately, whilst the areas covered here form what used to be called the ‘common sense’ part of social work law, in recent years the courts have shown this no longer to be the case. Furthermore, Parliament has been very active in this area, at least in terms of welfare benefits and so, this area like all others is covered by a patchwork quilt of legislation.
