ABSTRACT
The Attorney General has laid down guidelines as to when the prosecution can exercise the right:
• if a jury check shows information to support exercising the right to stand by; or
• if the person to be sworn in as a juror is unsuitable and the defence agree (Practice Note (1988)). Either side can challenge the array.
