Exclusive possession Unless there is exclusive possession there cannot be a lease, but exclusive possession does not mean there is always a lease. A lease gives protection under the Rent Act 1977 and the Housing Act 1988 for tenants of dwelling houses. If there is no lease, there is only a licence which does not come within these Acts.
