The relationship between private nuisance and public nuisance
There tends to be confusion between public and private nuisance. Public nuisance is a crime covering a number of interferences with rights of the public at large, such as brothel keeping, selling impure food and obstructing public highways. It is not tortious unless an individual proves that he has suffered particular damage beyond that suffered by the rest of the community.
