ABSTRACT
Case 1. If the account out of which the unauthorised payment was made was already, or thereby became, overdrawn, it may be regulated by the CCA. If the third party uses an ATM card, the matter will fall within CCA, s 83 (reg 21(4): see post, para 7.07A); and if he uses a credit card it will be dealt with by s 84 (see post, para 7.13), unless within case 2 (reg 21(5)).
