ABSTRACT
The protection of rights under common law The third limb of Dicey’s description of the rule of law reveals his preference for common law protection of human rights over and above a specially formulated code of rights, thus demonstrating a faith in the judiciary which is not sustainable nowadays. Evaluation of this aspect of the definition must await analysis of the Human Rights Act 1998 in Chapter 19 and the scope of the protection which it gives to individual citizens.
