ABSTRACT
An answer to this question should differentiate between Midas, who will seek a remedy from the company and/or the directors and/or Bering Associates, and Croesus, who might seek to pursue a claim against Midas. In respect of each complainant, the statutory and any common law remedies should be considered, noting that the Financial Services and Markets Act (FSMA) 2000 came into force in 2001.
