ABSTRACT
This question asks for a selection of proposals from the White Paper, and for opinion about the proposals. Which proposals are definable as ‘main’, as opposed to subsidiary or minor, is a matter of judgment but provided a good account is given as to why the candidate believes a proposal to be important, it does not matter which ones are selected. The proposals commonly seen as the main ones are those concerning:
• the double jeopardy rule; • disclosure of a defendant’s previous convictions; • trial by jury; • youth courts; • penalties for dilatory lawyers; • sentence discounts; • indeterminate sentences; • hearsay evidence; • police bail; • custody plus; • domestic violence; • the timetable for implementation of the schemes.
