ABSTRACT
The first [ground of appeal] is that the learned judge ought not to have given summary judgment in the respondent’s favour but should have given leave to defend and let the case go to trial. The relevant section under which he acted is s 86A of the Civil Procedure Code. This is similar to the English RSC Ord 86.
