Where the court office is closed on the day of expiry of a period, so that the act cannot be done on that day, the time extends to the next available day on which the office is open.2

An important power contained in Ord 33 is the court’s power by order to extend (or abridge) any time period laid down by the RSC for doing a particular act (for example, to file a pleading).4 The court may make the order on such terms as it considers just. An extension may be granted after the initial period has expired. The costs of the application will be borne by the party applying for the order, unless the court orders otherwise.
