In addition, a writ must be indorsed as to capacity.7 So, for example, where a plaintiff is acting as executor or administrator of a deceased’s estate, this must be stated in the indorsement.8

The Plaintiff’s claim is as Administrator of the Estate of Eugenia Devon (‘the Deceased’) for: (a) Damages under the Fatal Accident Act (Chap 71, Laws of The Common-

wealth of The Bahamas) as compensation for the death of the Deceased. (b) Damages under the Survival of Actions Act 1992 for the benefit of the estate

of the Deceased for loss of expectation of life and consequential loss caused to the Deceased, caused: (i) by the negligent driving of motor vehicle Registration number 9381 (in

which the Deceased was a passenger at all material times) by the First Defendant on or about the 20th day of February 2002 in or around Farrington Road, Nassau; and also

(ii) by the negligent driving (of motor vehicle Registration number 8695 of the Third Defendant) by the Second Defendant who was at all material times the agent or servant of the Third Defendant on or about the 20th day of February 2002 at or near Farrington Road, Nassau.
