ABSTRACT
Where conditional leave to defend is granted, it is indicative that the court considers the defence to be ‘shadowy’24 or to have ‘little or no substance in it’.25 Usually, the bona fides of the defendant is doubted, in which case the court may require the defendant to give security for costs, or order him to make a payment into court,26 or require a bank guarantee to be given.
