ABSTRACT

CPR r 34.2 provides that an order may not be made unless it is necessary to dispose fairly of the claim or to save costs, and when considering whether to make an order the court must have regard to: (a) the likely benefit which will result if the information is given; (b) the likely cost of giving it; and (c) whether the financial resources of the second party are likely to be sufficient to

enable that party to comply with the order.
