ABSTRACT
The guarantor’s liability extends, in theory, to procuring the principal to perform its
obligations.
As the guarantor is rarely in a position to procure the principal’s performance, it is
usual for the guarantee to be construed as an undertaking that the principal’s obli-
gations will be performed by the guarantor if the principal fails to perform them.
