ABSTRACT
A lender’s right is a non-possessory one that crystallises on default. The goods
are held in trust for the lender, which has an equitable charge or interest in the
goods.
Hypothecation is used if actual or constructive possession of the goods cannot
be given (eg: the goods are in a warehouse, or not in existence, or in the proc-
ess of being manufactured).
