ABSTRACT
By their actions, legislatures and courts extend the influence of tests by legitimizing their use for a host of functions-primarily by advancing the use of tests (e.g.; No Child Left Behind), and by providing an authoritative apparatus for the resolution of disputes regarding fairness and validity. The purpose of this chapter is to illustrate the interaction between the rules and law of testing, beginning with an examination of the role legislatures and courts play in advancing social and professional consensus regarding testing practice, and ending with illustrations of governmental leadership on testing issues.
