ABSTRACT

An incomplete transfer of property to the donee (or trustee) will be regarded as complete in a number of exceptional circumstances. The consequences of these principles are that the intended transferees are entitled to enlist the support of equity in order to perfect imperfect gifts. The claims may be brought even at the instance of volunteers. These are exceptions to the rule that ‘equity will not assist a volunteer’ or ‘equity will not perfect an imperfect gift’.
