ABSTRACT

The other mode of creating an express trust requires the settlor to declare that the relevant property retained by him is held as a trustee subject to the terms of the trust, that is, a self-declaration of trust. This mode has the advantage of requiring the settlor to execute one transaction, namely, the declaration of trust. No third party trustee is involved in the arrangement. The settlor’s interest will be converted from absolute entitlement to partial ownership as trustee for the beneficiaries as declared.
