ABSTRACT
A trust may be created only in respect of existing property. Accordingly, in Re Ellenborough, it was decided that a trust cannot be created in respect of an expectancy or future property, such as an anticipated interest under a will during the lifetime of the testator. The reason being that there is no property which is capable of being subject to the protection of equity.
