ABSTRACT
The test for certainty of objects varies with the nature of the transfer effected by the settlor. The position today is that if the settlor creates, on the one hand, a mere power of appointment or trust power, the test for certainty of objects is the ‘given postulant’ criterion. On the other hand, if the settlor creates a fixed trust, the test for certainty of objects is the ‘list test’.
