ABSTRACT

The earlier cases were consistent in applying the standard of proof in order to prove the terms of a secret trust, namely, ‘clear evidence’ of the terms of the trust analagous to the standard of proof required for rectification of an instrument. In short, the standard of proof was higher than the ordinary civil standard of a balance of probabilities.
