ABSTRACT
It is a question of construction to determine the scope and extent of the property subject to the agreement and thus the trust. If the agreement is expressed to bind the whole of the interest owned by each party, the trust will bind the entire property owned by each party and the surviving testator may be unable to deal with his own property during his lifetime.
