ABSTRACT
Section 76(2) further provides that a prosecutor may apply to the Court of Appeal to determine whether such an acquittal is a bar to the person being tried in England and Wales. In cases where there is found to be a bar, the prosecutor may then apply for an order that the acquittal should not be a bar.
