Answer Although we shall attempt to show that the statement under discussion does represent accurately the legal position, it should not be thought that any act which is done with the intent of damaging the business of another is automatically a tort. Such a proposition was expressly rejected by Hoffmann J in Associated Newspapers Group v Insert Media Ltd (1988), that is, English law does not recognise a tort of unfair trading.
