Obtaining property It is proposed to consider Grundy’s liability for the offence of dishonestly obtaining property (that is, the money from whisky buying customers) by deception contrary to s 15 of the Theft Act 1968. The maximum punishment is 10 years’ imprisonment. The principal issue for consideration is whether Grundy practised an operative deception within the meaning of s 15.
