ABSTRACT

In today’s society where increasing consideration is being given to human rights, the rights of the disabled and handicapped are becoming more significant. Throughout the industrial world legislation has been enacted, and to a greater or lesser extent enforced, to ensure that the presence of a disability does not give grounds for discrimination either in application for a job or assignment to a job simply because of its existence. A worker may be barred from a job because it is impossible for him/her to do the essential duties of that job by reason of disability, but not simply because a prima-facie impairment exists.
