ABSTRACT

Construction contracts are governed by the general law of contract, with which most students will be familiar. There are in addition some statutory rules, on payment and the settlement of disputes, which apply only to construction contracts. This Chapter considers the meaning of construction contracts for the statutory purposes and examines the way in which general principles of contract law apply in the construction context. It also looks in a little more detail at the formation of contracts by a process of tendering, since it is very common for construction contracts to be made in this way.
