ABSTRACT

This chapter attempts only to summarize the salient features of the lump sum contracts for landscape works. (For a full commentary see The Shorter Forms of Building Contract, Granada Publishing, London, 1984.)

5.1 The need for a Standard Form

Landscape contracts, like building contracts, differ from other contracts in that they are all ‘work and material’ contracts. They are not contracts solely for the sale of goods at common law, nor are they subject to the Sales of Goods Act 1979 even though the title in such materials as are required ultimately passes to the building owner. Equally, they are not contracts for services alone and are not therefore covered by the Supply of Goods and Services Act 1982, Part II.
