ABSTRACT
The elevation of the construction industry to the dubious honour of ‘best friend’ arises from their ability to swell the coffers of the legal profession. This arises due to the large number of legal actions particulary in negligence. It might be thought logical that each ‘best friend’ would suffer equal liability in negligence. It might be logical; but it is not true. The question of construction liability in negligence is extremely complicated and difficult. The following statement sums up the situation perfectly (2).
