ABSTRACT
The liability of consultants and contractors is not governed by statutory provisions. There is freedom in terms of contract, anybody can make a contract with any content (with some general exceptions, e.g. not contrary to public policy etc.). However, liability is mainly regulated by two documents: General Conditions for Works and Supplies for Building and Civil Engineering Works (AB 72) and General Conditions for Consulting Services (ABR 89). These are agreed documents in wide use in the building and consultancy sector. English translations of AB 72 and ABR 89 are available.
