Typically, this may occur during a 5-year period, 35 to 40 years after the transfer of all rights. The statutory rights or termination rights in publishing can be exercised during a 5-year period, 40 years after the date of transfer or 35 years after the date of first publication. In most situations, the reversion of all rights is negotiated through a contractual agreement. Publisher will often release a nonexclusive license if there are no unrecouped advances outstanding.
