ABSTRACT

The chapter is divided into four parts. In the first part, I shall define different types of piracy and outline some of the recording industry's current concerns regarding the personal use of copyrighted material. Following this, I shall question whether such concerns are well-founded by arguing that we must take into consideration how people use music in their everyday lives if we are fully to understand the effects of piracy. In the third section, I will question the basic assumptions of the industry argument through a discussion of the notion of 'fair use' within copyright law and by discussing how previously acceptable actions have come to be labelled as piracy. Finally, I shall detail how current industry campaigns to increase the strength of copyright protection are dramatically reducing potential fair uses of copyrighted music.
