ABSTRACT

The regulation or control of real estate is widely practised in democratic societies, affecting its ownership, use, management and development. Regulatory actions are those that compel, manage or eradicate certain activities or aspects of those activities. Ownership relations between landlord and tenants, for example, may be governed by statute so as to prevent automatic eviction at the end of a lease. Certain uses, such as night clubs, may be considered a potential public nuisance, with restrictions imposed on where and when they can operate. Management arrangements of multiple-occupied properties, for instance, may be controlled to ensure the health and safety of occupants and to minimise negative impacts on neighbours. The concern of this chapter, however, is with the regulation of real estate development and its implications for place quality.
