ABSTRACT

It is now more than 10 years since Scotland became the first part of the United Kingdom to introduce the European Convention on Human Rights (ECHR) into its system of laws. The Human Rights Act 1998 incorporated the Convention into Scots law with effect from 2 October 1998 and required all public authorities, including the police, to act in conformity with Convention rights. Through a substantial body of European and other distinctly Scottish jurisprudence which has developed, this chapter seeks to draw out the implications for policing in Scotland both in terms of police forces and the individual police officer.
