ABSTRACT

Planning permission is required for development, and development includes: ‘the making of any material change in the use of any buildings or other land’ (section 55(1) of the 1990 Act).

This chapter is largely concerned with the meaning of these words in order to understand the scope of development control over a material change of use. However, some uses are specifically excluded from development control; or are uses that do not need planning permission because they existed in 1948; or are uses that are now immune from enforcement action.
