ABSTRACT

A local planning authority may, by order, revoke or modify any planning permission that has been granted upon an application. They may do so having had regard to the provisions of the development plan and to any other material considerations (section 97 of the 1990 Act). This power is used sparingly; first, because the authority are liable to pay compensation; and, second, because a planning permission that is not implemented expires after three years; outdated planning permissions will hopefully just lapse.
