ABSTRACT

The Monopolies Commission always undertakes a detailed assessment of the nature of competition in dealing with dominant firm references. Effective competition has been welcomed, as a rule, by the Commission as providing a constraint upon the abuse of market dominance. A study of the competitive process is not, however, the limit of the Monopolies Commission’s task. The Monopolies Commission has always considered that it should assess the commercial activities of the dominant firm. Such a task is by no means simple. Economics provides little assistance to the Commission in relation to many commercial activities, either through lack of available tools of analysis or through lack of agreement among interpreters of the discipline. Many of the problems are exposed in the forthcoming analysis. The Monopolies Commission has concentrated upon six facets of dominant firm activity:

Price Discrimination;

Resale Price Maintenance;

Distribution Techniques;

Standardization of Product;

Research, Development and Innovation;

Export Activity.
