ABSTRACT
Chapter 4 considered the fi rst two main requirements to form an express trust: that the settlor must have mental and legal capacity and that, for certain types of property, formalities must be fulfi lled. This chapter moves on to consider the next requirement: that the trust must be certain. The requirement of certainty can itself be split into three parts: intention, subject matter and object.
