ABSTRACT

Part (b) is concerned with obligations of an agent, and the remedies of the principal for breach of such obligations.

As regards part (a), the suggested order of treatment is as follows.

v Authority: vstate the principles relating to an agent’s actual and apparent

authority; v state the requirements for apparent authority, as set out in Rama Corp

and Proved Tin and General Investments (1952); vdeal with the issue that the representation of authority must come

from the principal (Armagas Ltd v Mundogas Ltd (1986)), and the way in which this has been interpreted in First Energy (UK) Ltd v Hungarian International Bank Ltd (1993); and

vapply the above to the facts of the problem.
