ABSTRACT

The general principle with title to Plant and Materials brought onto a construction Site by the Contractor is that, in the absence of any contractual provision to the contrary, title will remain with the Contractor until they are finally incorporated (built) into the Works, at which point they will become the property of the Employer. Once title has passed, the Contractor cannot, without an express right in the contract, normally with the consent of the Contract Administrator, remove the Materials.
