CHILD MAINTENANCE BASED ON BLOOD RELATIONSHIP The main provisions for claiming maintenance from a child’s biological mother or father or an adoptive parent are found in the Child Support Act 1991 and the Child Support Act 1995 as amended by the Child Support Pensions and Social Security Act 2000 and the Child Maintenance and Other Payments Act 2008. These provisions enable a person with care (this could be a parent or another adult) to claim maintenance from the non-resident parent(s). A parent with care who is claiming State benefits has to make an application under the Child Support Act; a parent with care who is not in receipt of benefits or a non-parent carer has a choice whether to make such an application.
