ABSTRACT

Although both in pre-modern times and in the period of modernisation the Chinese legal system has had many interactions with the laws of neighbouring countries, the subject of this paper, the legal foundation for China’s economic security, is not one that easily lends itself to comparisons and generalisations within the regional Asian context. In particular, while China has become a regular participant in various regional intergovernmental organisations in recent years, none of these bodies, with the possible exception of the Asian Development Bank, has yet evolved legal norms which have a noticeable impact on the economic security either of China or its neighbours. Accordingly, while many of the papers presented at this conference have concerned themselves with China in a regional context, the present paper will confine itself to the narrower but nonetheless critical question of the legal foundation within China itself of the Chinese economy.
