ABSTRACT
Whilst the common law is, by definition, judge made, the extent to which judges can influence the operation of statute law through interpreting it in particular ways should not be underestimated.
It is obvious, but no less important for that, that the outcome of cases to a large extent depends upon what evidence the parties to the action can put before the court. That in turn is dependent upon the rules of evidence which apply in the courts.
