ABSTRACT

QUESTION 15 Alf left his car for repair at Maidstone Garage, carelessly leaving the car’s registration document in the glove compartment which was unlocked. While the car was at Maidstone Garage, Maidstone telephoned Alf and informed him that another customer had seen the car and wished to buy it for £3,000. Alf said that he had not intended to sell the car, but that if Maidstone were to receive an offer in excess of £4,500, he would be interested. Without again contacting Alf, Maidstone sold the car for £3,500 to Jenny, handing over the registration document and the ignition key. ◗ Consider the legal position.
