ABSTRACT

The built environment consists of man-made structures on land. It is essential for anyone living or working within this environment to understand the legal mechanisms that operate which allow acquisition and ownership of land and the rights of third parties. Different countries have different legal mechanisms and hence the implications for personal or business activities will vary. This chapter seeks to examine the situation in England and Wales, focusing on a range of issues including estates and interests, co-ownership, mortgages, restrictive covenants, easements and adverse possession. It also encompasses land registration and third-party rights. The subject is so complex that it is intended merely to provide a brief introduction to the main areas that a student of the built environment is likely to meet.
