ABSTRACT
The European Court of Justice is the judicial body of the European Community and is charged with ensuring uniform interpretation of the treaties. It has truly been an activist court and has extended the reach of Community law by ‘constitutionalising’ the treaties, forcing economic integration and defining human rights that bind Community institutions. If and when greater powers devolve on the European Parliament, the Court may, however, find its activism met with less enthusiastic approval.
